1. Agreement to these terms
By creating a Storkie account or using the Storkie application (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.
In these Terms, “you” means the person using the Service. “We,” “us,” and “Storkie” refer to the operators of the Service.
2. Who can use Storkie
You must be at least 18 years old (or the age of legal majority where you live) to create a Storkie account. Storkie is built for parents, legal guardians, and caregivers to log activities about children in their care.
By adding a child profile or logging activities for a child, you confirm that you are that child's parent or legal guardian, or that you have explicit permission from a parent or legal guardian to do so. Children do not directly use Storkie.
3. Your account
You are responsible for keeping your login credentials safe and for any activity that happens under your account. Notify us promptly if you suspect unauthorized use of your account.
Authentication is provided by Clerk. Their terms and privacy practices apply to the credentials they manage on our behalf.
4. Caregiver sharing
Storkie lets you invite caregivers (e.g. a co-parent, grandparent, or nanny) to view and/or contribute to your child's activity log. When you invite someone, you confirm that you have the authority to share that child's information with them.
You can revoke a caregiver's access at any time from Settings. Caregivers who have access to a child profile must also accept and abide by these Terms.
5. Your content
The activity logs, photos, and notes you create in Storkie are yours. You grant Storkie a limited, worldwide, non-exclusive license to host, store, transmit, and display that content solely for the purpose of operating the Service and providing its features to you and to caregivers you authorize.
You are responsible for the content you upload. Don't upload content that is unlawful, infringes anyone's rights, or that you do not have permission to share.
6. Acceptable use
You agree not to:
- Use the Service to violate any law or anyone's rights.
- Attempt to bypass security, rate limits, or access controls (including Row-Level Security policies).
- Probe, scan, or test the vulnerability of the Service without our written permission.
- Use automated systems to scrape, harvest, or abuse the Service.
- Upload malicious code, or content that exploits or endangers a child.
- Use the AI features (voice transcription, structured parsing, Ask Storkie) to generate or process content that violates applicable law or our acceptable-use rules.
7. AI features
Storkie includes AI-assisted features that send your audio or text to OpenAI for processing (voice-to-activity transcription, activity parsing, and the Ask Storkie chat assistant). AI outputs are generated by language models and can be wrong, incomplete, or misleading.
Storkie is not a medical device and does not provide medical advice. Suggestions, predictions, observations, and summaries generated by Storkie — including nap predictions, growth observations, and pattern detection — are informational only and must not be used as a substitute for advice from a qualified pediatrician or other healthcare professional. Always consult a qualified professional for medical decisions about your child.
8. Subscriptions and pricing
Storkie does not currently offer paid plans. Some features may become paid in the future. If they do, we will publish pricing and terms before charging anyone and will make the upgrade path opt-in.
9. Suspension and termination
You can stop using Storkie at any time. You can delete your account from Settings, which removes your account, child profiles, activity entries, and photos from our production systems (see the Privacy Policy for details).
We may suspend or terminate access to the Service if you breach these Terms, use the Service in a way that puts other users or the platform at risk, or if we are required to do so by law. Where reasonable, we will give you notice and an opportunity to cure.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data loss will not occur.
You are responsible for keeping your own copy of any data that matters to you. Storkie's export feature is available in Settings for this purpose.
11. Limitation of liability
To the maximum extent permitted by law, Storkie and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.
Nothing in these Terms limits liability that cannot be excluded under applicable law (for example, certain consumer-protection rights).
12. Indemnity
You agree to indemnify and hold harmless Storkie and its operators from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your breach of these Terms — except to the extent caused by our own fault.
13. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will update the “Effective Date” at the top of this page and, where appropriate, notify you in the app or by email. Continuing to use Storkie after the change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Storkie's operating entity is based, without regard to its conflict-of-laws principles. Specific venue and jurisdiction will be confirmed in the finalized version of this document.
